What is the e-Privacy directive?

The e-Privacy Directive, also known as the "Cookie Directive," is a European Union directive that aims to protect the confidentiality of electronic communications services, such as the Internet, e-mail, and mobile phones.

The e-Privacy Directive sets out rules and requirements for processing personal data and using cookies and similar technologies. Companies that provide electronic communication services need to obtain the consent of individuals before using cookies or similar technologies to track their activities, with the exception of strictly necessary cookies and trackers.

Like any Directive, the e-Privacy directive is not directly applicable. Member States have implemented the rules the Directive laid out in their national legislation. Data protection authorities enforce the rules of the Directive in each Member State.
